A Georgia gun dealer decided Monday not to go ahead to trial in a lawsuit that accuses him of selling guns that ended in the hands of criminals in New York City. Jay Wallace of Adventure Outdoors in Smyrna made the reversal just before opening arguments were to be heard in a New York City courtroom. Instead of a trial verdict, the judge overseeing the case will enter a decision--that could be challenged in the 2nd U.S. Circuit Court of Appeals.
Authorities say 21 illegal guns used in crimes in New York between 1996 and 2000 were traced to the Smyrna gun dealer. It was one of 27 out-of-state gun shops sued by the city two years ago. Most either settled, went out of business, or had cases dropped.
