A Spanish court has upheld the indictment of three American soldiers from Fort Stewart near Savannah. The soldiers are charged with firing a tank shell at a Baghdad hotel in April 2003 and killing TV cameraman Jose Couso. The national prosecutors' office argued it had not been a crime, but rather an accident of war. But the judge ruled the three Americans had used indiscriminate and excessive force when they opened fire.
